Is a pilot eligible to receive Layover Allowance (over and above the TDY allowance) while being on a temporary duty assignment (TDY)?
The purpose of providing layover allowance to pilots is to help them cover incidental expenses which may include meals etc. However, during a temporary duty assignment (TDY), a pilot is provided with the TDY allowance as per company policy depending on the length of the TDY. A pilot who is on a TDY at a particular base may be assigned on a layover to another station and possibly his actual crew base, and in such cases the following is applicable:
• Domestic Layover during TDY
The TDY allowance is either equal to or more than the normal domestic layover allowance depending on the length of the TDY. Hence, no additional Layover Allowance is applicable on a domestic layover since the pilot will be provided with the TDY allowance for the layover he undertakes while he is on TDY. In case a pilot is operating a flight in which he/she is flying through the night, then neither layover nor TDY allowance will be paid for that night.
• International Layover during TDY
If a pilot undertakes an international layover while he is on TDY, then the pilot will be paid the international layover allowance as per company policy.
The layover or the TDY allowance as applicable is paid on a per night basis only if the pilot is in the hotel for that night. If the pattern involves a flight in which the pilot is, in fact, flying through the night, in that case, NO allowance will be paid as the pilot is in air and will be eligible for an allowance once he reaches a hotel to begin a layover.
Example: A pilot undertakes a TDY to MAA for 15 days. His TDY allowance will be as per the length of the TDY which is 15 days. From MAA, the pilot is assigned a 4-day pattern. On DAY 1 the pilot operates MAA-DXB and reaches DXB at 2100 Hrs. Hence, he will be paid the international layover allowance for his hotel stay in DXB. On DAY 2 the pilot departs DXB at 2330 Hrs. and arrives in TRV at 0400 Hrs. on DAY 3. Since the pilot was in transit on the intervening night of DAY 2 & 3, he will not be eligible for any allowance for that night as understandably there are no such expenses to cover while the pilot is in flight. On DAY 3 the pilot does a layover in TRV, so he will now be eligible for the TDY allowance as it is a domestic layover during his TDY. DAY 4 the pilot returns to MAA, and he will again be eligible for a TDY allowance on DAY 4. From here on, the pilot will continue to get TDY allowance for the remaining TDY till his 15 days are completed in MAA.
To conclude, there is NO provision to pay DUAL allowances for the purpose of covering incidental expenses for a pilot when he/she is out of their home base. Therefore, on a per night basis, a pilot can either be paid a layover allowance, be it domestic or international, OR a TDY allowance but never BOTH.
